Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tribarro website builder platform ("Service"), operated by Tribarro ("we", "us", or "our") at tribarro.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use Tribarro. By using the Service, you represent that you are using it for lawful business purposes and have the authority to bind any business entity on whose behalf you use the Service.

Tribarro provides a website builder that allows businesses to create and publish websites on subdomains of tribarro.com. We host your site, store your content, and provide the tools to manage it. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

Tribarro offers two paid plans:

• Base: $10/month or $90/year — includes subdomain, photo gallery (up to 20 photos), social links, WhatsApp button, menu/portfolio, and EN/ES localization toggle
• Pro: $20/month or $180/year — everything in Base, plus custom domain, contact form, Google Maps embed, Google Analytics integration, and no Tribarro branding

New subscribers receive a 30-day free trial. Users who have previously subscribed are not eligible for the free trial and are charged immediately upon resubscription.

Payments are processed by Stripe. Your subscription renews automatically at the end of each billing period (monthly or annual) unless cancelled. You authorize us to charge your payment method on file for each renewal.

We reserve the right to change subscription prices with at least 30 days' prior notice by email. Your continued use of the Service after the price change takes effect constitutes acceptance of the new price.

If you cancel your subscription, you are entitled to a pro-rated refund for unused days in your current billing period. For example, if you are on a monthly plan, paid $20, and cancel 10 days into a 30-day period, you are eligible for a refund of approximately $13 (20/30 × $20).

To request a refund, email legal@tribarro.com within 14 days of the charge you are disputing. Refunds are processed to your original payment method within 5–10 business days. Refund requests submitted more than 14 days after the charge are not eligible.

Free trial periods are not eligible for refunds.

You may cancel your subscription at any time through the billing portal. Cancellation takes effect immediately — your sites will go offline upon cancellation. We do not offer partial-period access after cancellation.

Cancellation does not automatically delete your account data. Your data is retained for 90 days after cancellation, during which you may resubscribe to regain access. After 90 days, your data is permanently deleted. See our Privacy Policy for details.

You agree not to use Tribarro to publish or facilitate:

• Illegal content or activities
• Spam or unsolicited commercial communications
• Content that infringes third-party intellectual property rights
• Malware, phishing, or other malicious content
• Content that harasses, threatens, or defames individuals
• Impersonation of another person or business

We reserve the right to suspend or terminate any site that violates these rules, without prior notice, at our sole discretion. We may also report illegal activity to appropriate authorities.

You are solely responsible for all content you publish on your Tribarro site. Tribarro acts as a passive hosting provider and is not liable for your site content under the Digital Millennium Copyright Act (DMCA) safe harbor provisions and equivalent laws.

If you receive a copyright infringement claim related to your site content, you are responsible for addressing it. To submit a DMCA takedown notice regarding a Tribarro-hosted site, contact legal@tribarro.com.

Tribarro and its licensors own all rights in the platform, templates, and software. You retain ownership of all content you create and upload to your site. You grant Tribarro a limited license to host, store, and display your content solely for the purpose of providing the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. We do not offer a formal uptime guarantee.

To the maximum extent permitted by applicable law, Tribarro's total liability to you for any claim arising from these Terms or your use of the Service is limited to the fees you paid to Tribarro in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Tribarro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your site content, your use of the Service, or your violation of these Terms.

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before the effective date.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, except where prohibited by local law.

Nothing in these Terms limits your rights under the GDPR (EU/EEA residents), the LGPD (Brazil), or other applicable mandatory consumer protection laws in your jurisdiction. Those statutory rights are not affected by this governing law clause.
